Terms of Service

1. About these terms

These Terms of Service (the "Terms") govern your use of the BuyNow mobile app and related services (the "Service"), operated by BuyNow. By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

We may update these Terms from time to time. If we make material changes, we'll let you know in the app. Continuing to use the Service after a change means you accept the updated Terms.

2. Who can use BuyNow

You must be at least 18 years old, or the age of majority where you live, to use BuyNow and to make purchases. You're responsible for keeping your account details and password secure, and for everything that happens under your account.

Please give us accurate information when you sign up, and keep it up to date, especially your delivery address and phone number, which we and your rider use to complete deliveries.

3. Orders and delivery

BuyNow connects you with vendors (restaurants, stores, markets and pharmacies) and independent riders. When you place an order, you're entering into a purchase with the vendor; BuyNow facilitates the order, payment and delivery.

Delivery fees are calculated from the distance between the vendor and your delivery address and may include surge pricing at busy times. The fee is shown before you pay. Estimated delivery times are estimates, not guarantees.

You're responsible for providing accurate delivery details and for being reachable. If a delivery can't be completed because we can't reach you or the address is wrong, you may not be entitled to a refund.

4. Gift orders and parcels

You can send an order as a gift to someone else, or send a parcel between two addresses. You're responsible for the accuracy of the recipient's details and for ensuring the recipient consents to receiving the delivery.

Parcels must not contain illegal, dangerous, perishable-without-notice, or prohibited items. We may refuse or cancel a parcel we reasonably believe breaches these Terms or the law.

5. Payments, wallet and refunds

Payments are processed securely by our payment partner, Paystack. We don't store your full card details. By paying, you authorise the charge for your order total, including items, applicable taxes (VAT) and the delivery fee.

Where an order is cancelled and a refund is due, the amount is credited to your in-app BuyNow wallet, ready to use on a future order, unless we tell you otherwise. Wallet balances are not redeemable for cash.

Promo codes and referral credits are subject to their own conditions and may be changed or withdrawn at any time.

6. Cancellations

You can cancel an order before the vendor begins preparing it; once preparation starts, an order generally can't be cancelled. Eligible cancellations are refunded to your wallet as described above.

We may cancel an order if a vendor is closed or unable to fulfil it, if payment fails, or if we suspect fraud or a breach of these Terms.

7. Acceptable use

You agree not to misuse the Service, including attempting to defraud vendors, riders or BuyNow, abusing promotions, harassing riders or other users, posting unlawful content in chat, or interfering with the app's operation or security.

Chat messages between you and your rider are provided to coordinate delivery. Keep them respectful and relevant. We may review messages where needed to investigate abuse or safety concerns.

8. Ratings and reviews

You may be invited to rate vendors and riders. Ratings must be honest and based on your own experience. We may remove content that is abusive, misleading, or violates these Terms.

9. Service availability

We work hard to keep BuyNow available, but we don't guarantee the Service will always be uninterrupted or error-free. We may suspend or change features to maintain, improve or secure the Service.

10. Liability

BuyNow facilitates orders between you, vendors and riders. To the extent permitted by law, we're not liable for the quality, safety or legality of items sold by vendors, and our liability for any claim relating to an order is limited to the amount you paid for that order.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including the Consumer Protection Framework and other Nigerian law.

11. Termination

You can stop using BuyNow at any time, and you can delete your account and personal data from the app at any time, see our Support page. We may suspend or close your account if you breach these Terms, if required by law, or to protect the Service, vendors, riders or other users.
